General Terms and Conditions of Sale – FairAway

1. Purpose

These General Terms and Conditions of Sale define the terms and conditions under which FairAway, a specialist in tailor-made golf travel to Vietnam, provides travel design, consulting, and support services.

FairAway designs personalized itineraries and assists its clients throughout the preparation of their trip.

For the marketing, booking, and organization of travel services, FairAway works with a travel operator established in France, which handles the activities falling within its role as a travel operator in accordance with applicable legislation.

The travel services included in a trip may include accommodation, golf courses, transfers, tours, activities, and other travel-related services.

2. Our Services

FairAway provides, in particular:

• Analysis of the client's needs, expectations, and preferences;

• Design of tailor-made travel itineraries;

• Selection and recommendation of golf courses, accommodations, and experiences;

• Research and selection of local partners and service providers;

• Optimization of itineraries and travel times;

• Assistance in preparing the client's trip;

• Follow-up and support within the framework agreed with the partner travel operator.

FairAway provides its expertise in Vietnam and golf travel in order to design a coherent, personalized experience tailored to the client's travel plans.

3. Trip Design and Booking

The trip is designed by FairAway based on the information provided by the client.

Once the itinerary and quotation have been approved, the booking, payment, and trip confirmation procedures are specified in the contractual documents provided to the client.

Where the trip constitutes a package or falls within regulations applicable to travel operators, the booking and sale of the trip are carried out within the framework of the partnership established with the relevant travel operator.

The client will receive all applicable contractual documents and mandatory information before the final confirmation of the trip.

4. Prices and Payment

Prices provided to the client are expressed in euros and include all applicable taxes where required by law.

The price of the trip may include:

• The selected travel services;

• FairAway's travel design and support services;

• Any applicable fees or services related to the organization of the trip.

Payment terms, deadlines, and any deposits are specified in the quotation and contractual documents provided to the client.

Amounts corresponding to the price of the trip are collected in accordance with the arrangements established with the partner travel operator.

5. Partners and Service Providers

FairAway carefully selects its partners and service providers, taking into consideration their quality, experience, and ability to meet travelers' expectations.

FairAway may work with its own partners in Vietnam as well as with partners proposed or referenced by its partner travel operator.

Where services are included in a trip sold by the partner operator, contractual relationships with the various service providers are organized in accordance with the arrangement established between FairAway and the operator.

6. Liability

FairAway undertakes to exercise due care in designing and supporting the trips entrusted to it.

Where the trip is sold within the framework of the partnership with the travel operator, the obligations and liabilities relating to the sale and organization of the trip are assumed by the travel operator in accordance with applicable law and the contractual documents provided to the client.

The services are provided by the various travel service providers selected for the trip.

The respective responsibilities of FairAway, the partner operator, and the service providers are determined according to their respective roles and the contractual documents applicable to the trip.

7. Changes and Cancellation

Any request to modify or cancel a trip must be submitted in accordance with the procedures specified in the contractual documents provided to the client.

The cancellation and amendment conditions applicable to travel services are those set out in the travel contract and/or the terms and conditions of the relevant service providers.

Additional fees may apply depending on the date of the request and the applicable contractual conditions.

8. Intellectual Property

The itineraries, recommendations, content, documents, and materials created by FairAway as part of its services are protected by applicable intellectual property laws.

They are intended for the client's personal use and may not be reproduced, distributed, marketed, or provided to third parties without FairAway's prior written authorization.

9. Personal Data

FairAway collects and processes personal data necessary to manage inquiries, design trips, and provide client support.

Such data is processed in accordance with applicable French legislation and the General Data Protection Regulation (GDPR).

Where necessary for the organization of the trip, certain data may be shared with the partner travel operator or relevant service providers.

The client may exercise their rights of access, rectification, erasure, restriction of processing, and objection in accordance with applicable regulations.

10. Complaints and Disputes

Any complaint relating to the design or support services provided by FairAway may be addressed directly to FairAway.

Any complaint relating to the execution, booking, or services included in the trip must be submitted in accordance with the procedures specified in the contractual documents provided to the client.

The parties shall seek to resolve any dispute amicably as a priority.

Where applicable, information regarding consumer mediation shall be provided in the contractual documents issued by the seller of the trip.

11. Travel Operator Partnership

FairAway works in partnership with a travel operator established in France for services falling within the regulations applicable to travel operators and package travel.

This partnership enables FairAway to retain its role as the designer of the trip and the client's main point of contact, while relying on a qualified travel operator for the commercial and legal organization of the trips.

Information regarding the identity, contact details, and legal status of the operator acting as the seller of the trip will be provided to the client in the applicable contractual documents.

12. Final Provisions

These General Terms and Conditions of Sale are governed by French law, subject to any mandatory provisions applicable to consumers.

These terms and conditions may be supplemented, where necessary, by specific terms and conditions and contractual documents provided to the client when booking the trip.
