Terms and Conditions – FairAway

1. Purpose

These Terms and Conditions define the terms under which FairAway, a consulting firm specializing in tailor-made golf travel in Vietnam, provides advisory, support, and referral services for the organization of golf trips.

FairAway does not make any bookings or collect payments for tourist services (flights, accommodations, green fees, transfers, activities). All services are booked and paid for directly by the client or through their usual travel agency.

2. Our Services

FairAway provides consulting and support services, which include, but are not limited to:

• Analysis of client needs and preferences

• Creation of tailor-made itineraries and personalized recommendations

• Referrals to reliable local partners

• Assistance before and during the trip

• Optimization of golf courses and practical advice

These services are provided for advisory purposes only. FairAway is not responsible for the execution, quality, availability, or billing of tourist services booked by the client or their agency.

3. Orders and Service Provision

• Any FairAway service order is confirmed upon signing a quotation or contract and payment of the agreed fees.

• Fees cover consulting and support services only and do not include any costs related to tourist services.

• The client retains full freedom to book directly with the recommended partners.

4. Fees and Payment

• Fees are indicated excluding tourist services and are expressed in euros (€).

• Payments are due according to the terms specified in the quotation or contract.

• In case of late payment, FairAway reserves the right to suspend its support until full payment is received.

5. Liability

• FairAway commits to providing advice and recommendations based on its expertise and knowledge of Vietnam and its golf courses.

• FairAway is not responsible for cancellations, delays, modifications, incidents, or disputes related to tourist services booked directly by the client or their agency.

• FairAway’s liability is limited to the advice provided and the quality of its support

6. Cancellation and Modification

• Any request to cancel or modify consulting services must be made in writing.

• Applicable financial conditions (partial or full refund of fees) are specified in the quotation or contract.

• Tourist services booked directly by the client are subject to the cancellation policies of the relevant service providers.

7. Intellectual Property

• Documents, itineraries, advice, and materials provided by FairAway are protected under intellectual property law.

• They are intended for the client’s personal use only and may not be reproduced, distributed, or sold without FairAway’s written authorization.

8. Personal Data

• FairAway collects and uses personal data necessary to provide its services.

• Data is processed in accordance with French law and GDPR.

• Clients may exercise their rights of access, rectification, and deletion by contacting FairAway.

9. Applicable Law and Jurisdiction

• These Terms and Conditions are governed by French law.

• In case of a dispute concerning the interpretation or execution of these Terms, the parties will first seek an amicable solution.

• If no agreement is reached, the dispute will be brought before the competent courts in the jurisdiction of FairAway’s registered office.

10. Important Legal Notice

• FairAway is a golf travel consulting firm and is not a travel agency.

• All recommendations, referrals, and advice provided do not constitute sales or bookings of tourist services.

• The client retains full responsibility for booking and paying for tourist services directly with the partners or their usual travel agency.
